The article examines possible amendments to the Australian legislative regime regulating and protecting Indigenous cultural heritage in offshore, including underwater, contexts. It highlights the need for significant reforms to bring the domestic legislative framework into conformity with the expectations of contemporary international law, particularly those expressed in the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). The analysis is based on recent Australian jurisprudence and archaeological studies, considering both offshore Indigenous cultural heritage and the current domestic legislative framework. The article then examines the relevant provisions of both the UNDRIP and the 2001 UNESCO Convention on the Protection of Underwater Cultural Heritage (UCH Convention). It finds that the UCH Convention does not recognize any legitimate role for Indigenous peoples and does not provide an appropriate foundation for legislative reform. The article concludes by suggesting the content of appropriate legislative reforms that conform to the expectations of the UNDRIP.
